Techweek Code of Conduct

Techweek is an inclusive, friendly, progressive space in which to discover and discuss NZ technology, design and innovation that’s good for the world.

It is an initiative that welcomes all people and we expect all event hosts and attendees to treat each other with respect and kindness regardless of gender, sexual orientation, ethnicity, age, physical ability, political beliefs or appearance. We expect Techweek event hosts and participants to act with integrity and in a collaborative manner that builds trust, and to respect the environment they are holding and attending events in. This is a place for collective enthusiasm, excitement and curiosity and we will not tolerate behaviour that runs counter to these values.

If we witness behaviour that is inappropriate or at odds with the spirit of Techweek, we reserve the right to ask those involved to leave any event(s), and to restrict their attendance at future Techweek events.

Techweek’18 Website Terms of Use


1. APPLICATION OF TERMS

1.1 These Terms apply to your use of the Website. By accessing and using the Website:
a) you agree to these Terms; and
b) where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

1.2 If you do not agree to these Terms, you are not authorised to access and use the Website, and you must immediately stop doing so.

2. CHANGES

2.1 We may change these Terms at any time by updating them on the Website. Unless stated otherwise, any change takes effect immediately. You are responsible for ensuring you are familiar with the latest Terms. By continuing to access and use the Website, you agree to be bound by the changed Terms.

2.2 We may change, suspend, discontinue, or restrict access to, the Website without notice or liability.

2.3 These Terms were last updated on 17 October 2017.

3. DEFINITIONS

In these Terms:
including and similar words do not imply any limit
Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis
personal information means information about an identifiable, living person
Terms means these terms and conditions titled Website Terms of Use
Underlying System means any network, system, software, data or material that underlies or is connected to the Website
User ID means a unique name and/or password allocated to you to allow you to access certain parts of the Website
We, us or our means Techweek NZ
Website means www.techweek.co.nz and discovery.techweek.co.nz
You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

4. YOUR OBLIGATIONS

4.1 You must provide true, current and complete information in your dealings with us (including when setting up an account), and must promptly update that information as required so that the information remains true, current and complete.

4.2 If you are given a User ID, you must keep your User ID secure and:
a) not permit any other person to use your User ID, including not disclosing or providing it to any other person; and
b) immediately notify us if you become aware of any disclosure or unauthorised use of your User ID, by sending an email to hello@techweek.co.nz

4.3 You must:
a) not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and
b) unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

4.4 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms, including any failure of a person who accesses and uses our Website by using your User ID.

5. INTELLECTUAL PROPERTY

We (and our licensors and event partners) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

6. DISCLAIMERS

6.1 To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:
a) the Website being unavailable (in whole or in part) or performing slowly;
b) any error in, or omission from, any information made available through the Website;
c) any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and
d) any site linked from the Website. Any link on the Website to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators.

6.2 We make no representation or warranty that the Website is appropriate or available for use in all countries or that the content satisfies the laws of all countries. You are responsible for ensuring that your access to and use of the Website is not illegal or prohibited, and for your own compliance with applicable local laws.

7. LIABILITY

7.1 To the maximum extent permitted by law:
a) you access and use the Website at your own risk; and
b) we are not liable or responsible to you or any other person for any Loss under or in connection with these Terms, the Website, or your access and use of (or inability to access or use) the Website. This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.

7.2 Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability is limited to NZD100.

7.3 To the maximum extent permitted by law and only to the extent clauses 7.1 and 7.2 of these Terms do not apply, our total liability to you under or in connection with these Terms, or in connection with the Website, or your access and use of (or inability to access or use) the Website, must not exceed NZD100.

8. PRIVACY POLICY

8.1 You are not required to provide personal information to us, although in some cases if you choose not to do so then we will be unable to make certain sections of the Website available to you. For example, we may need to have your contact information in order to provide you with updates from our Website.

8.2 When you provide personal information to us, we will comply with the New Zealand Privacy Act 1993.

8.3 The personal information you provide to us (including any information provided if you register for an account) is collected and may be used for communicating with you, statistical analysis, the marketing by us of products and services to you, credit checks (if necessary), and research and development.

8.4 We may also collect technical information whenever you log on to, or visit the public version of, our Website. This may include information about the way users arrive at, browse through and interact with our Website. We may collect this type of technical information through the use of cookies and other means. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive to enable our systems to recognise your browser. If you want to disable cookies, you may do so by changing the settings on your browser. However, if you do so, you may not be able to use all of the functions on the Website. We use the technical information we collect to have a better understanding of the way people use our Website, to improve the way it works and to personalise it to be more relevant and useful to your particular needs. We may also use this information to assist in making any advertising we display on the Website more personalised and applicable to your interests.

8.5 Generally, we do not disclose personal information to third parties for them to use for their own purposes. However, some of the circumstances in which we may do this are:
a) to service providers and other persons working with us to make the Website available or improve or develop its functionality (e.g. we may use a third party supplier to host the Website);
b) in relation to the proposed purchase or acquisition of our business or assets; or
c) where required by applicable law or any court, or in response to a legitimate request by a law enforcement agency.

8.6 Any personal information you provide to us may be stored on the secure servers of our trusted service providers, which may be located outside New Zealand. This may involve the transfer of your personal information to countries which have less legal protection for personal information than New Zealand.

9. SUSPENSION AND TERMINATION

9.1 Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Website (or any part of it).

9.2 On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

10. GENERAL

10.1 If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

10.2 These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the Courts of New Zealand in relation to any dispute connected with these Terms or the Website.

10.3 For us to waive a right under these Terms, the waiver must be in writing.

10.4 Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 4.5, 5, 6, 7, 10.1, continue in force.

10.5 If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these Terms. The remainder of these Terms will be binding on you.

10.6 These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.

 

Techweek’18 Event Terms and Conditions

Please read these Terms and Conditions (Terms) carefully before purchasing a ticket to a Techweek’18 event (Event). In these Terms, a Headline Event means an Event that is managed and owned directly by the Company (defined below) and a Festival Event means an Event that is managed and owned by a third party. By purchasing a ticket for an Event through this Site, you agree to be bound by these Terms.

THE COMPANY

In this document the ‘Company’, ‘we’ and ‘us’ refers to New Zealand Technology Industry Association Incorporated, incorporated society number 2198280 (who is responsible for running Techweek’18).

COPYRIGHT AND USE

The information contained within this website (Site) (including programming scripts, graphics and logos) is the copyright of the Company (or, in respect of articles and other information provided by contributors, those contributors). You may use this Site and the information contained within it for your own personal or internal business purposes only. You may make any copies of any information reasonably incidental to your viewing of this Site and may retain a single permanent copy of that information for your personal reference. The information may not otherwise be used, copied, adapted, reproduced, published, stored in a retrieval system, altered, transmitted in any form or by any means in whole or in part (except where by law such use cannot be prohibited) without the prior written approval of the Company (or, in respect of articles or other information provided by contributors, those contributors).

You agree that you will not hack, or attempt to hack, into this Site nor employ any robot, spider or other device or process to use this Site for any unauthorised purposes. You agree that you will not take any action that imposes an unreasonably large burden on this Site.

TRADEMARKS

The trademarks appearing on this Site are primarily trademarks of the Company. Other trademarks displayed on this Site are trademarks of their respective owners. Nothing contained on this Site should be construed as granting any licence or right of use of any trademark displayed on this Site without the express written permission of the Company.

PRIVACY

We may collect personal information we need to provide and promote Events and other services to you directly from you or indirectly through your use of this Site. You agree that we may retain and use such information for the purposes of facilitating your participation in Events and keeping you informed of developments or matters relating to Events to which you have subscribed. If you indicate that you wish to receive email, mobile text or other communications from us and our third party sponsors, we may continue to use and disclose your personal information for marketing and promotional purposes. You may opt-out of receiving communications from us at any time by using the unsubscribe link, following the relevant instructions, or by emailing hello@techweek.co.nz.

Your name and organisation may be shared with other Event attendees and Festival Event organisers. You have a right to access and correct the personal information that we collect and hold about you at any time. If, at any time, your details change or you would like to access any personal information we have collected or hold about you, or, you would like more information on our approach to privacy, please read our Privacy Policy or let us know by emailing hello@techweek.co.nz

ONLINE SALES

Bookings for most Events can be made through the Site. Where you purchase an Event ticket through the Site, you are bound by the relevant provisions of these Terms. We reserve the right to change the ticket price at our discretion, although any such changes will not apply to tickets that have already been issued and paid for at the time the change is made.

For some Festival Events, you may be required to purchase tickets through the Festival Event organiser’s website and not the Site. In these cases, privacy terms, ticketing processes, payment and purchasing terms and conditions are independent of the Company. We recommend that you review the relevant Festival Event organiser’s terms and conditions and privacy policy. We will not be liable for any action or inaction of a Festival Event organiser, nor any breach by a Festival Event organiser of its own terms and conditions.

CUSTOMER SERVICE POLICY

All bookings made through this Site will be confirmed in writing within seven days of receipt of payment. If an Event is sold out and we are unable to confirm tickets, you will be notified within 48 hours of submitting your booking and all money paid by you will be refunded in full.

CANCELLATION, TRANSFERS AND REFUND POLICY

Cancellation and transfer requests vary according to whether the Event is a Headline Event or Festival Event.

Headline Events:

If you who wish to cancel your attendance to one or more Headline Event you must to log in to your Eventbrite account and request a refund. A 50% refund will be given to cancellation requests received by Eventbrite before 5pm (NZT) 21 April 2018. No refunds will be given to cancellations received after 5pm (NZT) 21 April 2018.

If you cannot attend a Headline Event, you can transfer your ticket to another individual prior to 5pm (NZT) 5 May 2018 so long as there are no programme changes required. An admin fee of NZD$50 applies to any transfer requests.  The admin fee must be paid in full before any changes can be confirmed. Transfers must be made by logging into the Eventbrite account and requesting the transfer.

We reserve the right to cancel any Headline Events at any time without notice. Full refunds will be given where we cancel a Headline Events. We reserve the right to change the date, time, venue, content or speakers of Headline Events at any time and we will notify you of any such changes where it is practical to do so. We do not accept any liability for any accommodation, travel or associated bookings made by you.

Festival Events:

As each Festival Event is managed and owned by individual Festival Event organisers, if you wish to cancel or transfer your attendance to one or more Festival Event you should refer to the Festival Event listing and ticketing system for cancellation, transfer and refund policies. You should contact the relevant Festival Event organiser, and not the Company, to ascertain applicable policies.

Festival Events are managed by event organisers that are separate from the Company, and as such, the Company is not responsible for the delivery, quality and organisation of Festival Events.

PAYMENT AND SECURITY

All payments for Event tickets purchased through the Site will be charged to your nominated credit card and processed by Eventbrite. We recommend that you review the Eventbrite terms and conditions when you complete the registration process. We will not be liable for any action or inaction of Eventbrite, nor any breach by Eventbrite of the Eventbrite terms and conditions.

All ticket payments must be received in full prior to arrival on site to allow entry to the Event. 

CONDITIONS OF ENTRY

Admission to Events is subject to the Techweek’18 Code of Conduct - https://techweek.co.nz/terms-and-policies/,these Terms, and, if the Event is a Festival Event, applicable terms and conditions of the Festival Event organiser (Festival Event Terms).

You may be denied entry into, or removed from, an Event where the Company has reasonable grounds to do so, including if you breach these Terms, the Techweek’18 Code of Conduct or any applicable Festival Event Terms, or you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the Event by others.

If you arrive late, you may not be admitted until a suitable break in the Event.

You may not be permitted to take into, or use during, an Event, cameras or other photographic or recording equipment (including mobile phones).

You may be required to submit to a search of your person and/or possessions before entering an  Event.

WARRANTIES LIMITATION OF LIABILITY

Save for any warranties provided by us in writing no warranties are given in respect of this Site or any Event and, to the extent permitted by law, all warranties, whether express or implied, and by statute or otherwise, are expressly excluded and we shall have no liability in relation to the same.

To the extent permitted by law we will not be liable for any loss or damage (including consequential loss or damage, loss of profits, loss of revenue or loss of savings) which may be suffered or incurred, or which may arise directly or indirectly in respect of your access to, or use of, or the unavailability of or your inability to use, this Site or any Festival Event, whether based in contract, tort, negligence, statute or otherwise.

To the extent permitted by law we will not be liable for any consequential loss or damage, loss of profits, loss of revenue or loss of savings which may be suffered or incurred, or which may arise directly or indirectly in respect of your use of, or our supply or inability to supply, a Headline Event to which you have purchased a ticket, whether based in contract, tort, negligence, statute or otherwise.

If, for any reason, we are liable for any direct loss or cannot rely upon the limitations and exclusions in the preceding paragraphs, then to the extent permitted by law our aggregate liability to you for any claim whatsoever is limited to the greater of NZ$50.00 or the value of the Headline Event ticket you have actually purchased through the Site.

DISCLAIMER

While we have endeavoured to ensure that the contents of this Site are complete, true and accurate, the contents of this Site are provided for general information and interest only. We do not provide any warranty or guarantee in relation to the contents of this Site including, without limitation, any articles or information provided to us by our contributors and to the fullest extent permitted by law we exclude all liability for the same.

LINKING

This Site includes links to third party websites. We have no control over linked sites and we are not responsible for the contents of such sites. We do not endorse or make any representations about the accuracy of information or regarding any products or services found on any linked sites.

GENERAL PROVISIONS

If any part of these Terms is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect.

These Terms are governed by the laws of New Zealand. You irrevocably submit to the non-exclusive jurisdiction of the courts of New Zealand.

PHOTOGRAPHY

Photographs and/or audio/video recordings taken during an Event by the Company or Festival Event organiser, or others on behalf of the Company or Festival Event organiser, may include an attendee’s image, name, voice and/or likeness. By attending and/or participating in a Headline Event, each attendee grants the Company permission to use the attendee’s photograph, image, likeness, voice and statements for any purpose, including but not limited to commercial purposes, without compensation or credit to the attendee in any and all media now known or hereafter devised.

VARIATION

We may vary these Terms at any time. Any variations become effective immediately once they are posted on this Site. By continuing to use this Site after these Terms have been varied you agree to be bound by these Terms as varied. We will advise you of variations to these Terms by updating the date of the “Last Updated” notice at the beginning of these Terms.
